Staff Present: Drew McManus (Conservation Agent) and Kris Carpenter (Administrative Secretary)
The meeting was called to order with a quorum by Commissioner Allen at 6:55 pm.
There was no public comment.
Pre/Post Hearing Agenda
1) Approval of Minutes from 1/21/10
Motion made, seconded and unanimously carried to approve the minutes of 1/21/10.
2) Town of Mashpee 5 Year Open Space & Recreation Plan: (2 yr extension for years 6 & 7)
The purpose of developing a plan like this is to show how the Town looks to manage existing open space and recreation facilities as well as inventory our natural resources. The plan also lists potential land acquisitions throughout the 7 year window. The Mass State Executive Office of Environmental Affairs (EOEA) added an additional 2 years to open space plans and as a result, the Town Planner and Conservation Agent came up with a list of potential parcel acquisitions for years 6 & 7. Open Space and Rec Plans are necessary in order to apply for state self help grant funds for land acquisition. The agent requested the endorsement of the Chairman for land acquisitions listed in years 6 & 7 of the plan.
3) Administrative Approval for 401 Monomoscoy Road (SE 43-2531); Construct driveway and parking area and also a 4’ path connecting parking area to approved pathway.
John Slavinski from Cape & Islands Engineering is representing the homeowner. Agent McManus explains that this lot was approved for a single family home approximately a year ago and at that time, there were issues regarding the setback from the salt marsh and whether or not a coastal bank was present on the parcel. An outside consultant was hired under 44-53G to verify the presence of a coastal bank for the purposes of determining setbacks in land subject to coastal storm flow. No coastal bank was found in the official determination. Currently, the lot is still not cleared and they would like to provide a pathway to a dock and pier that has already been constructed. Mr. Slavinski states that they are using the same exact driveway location and all clearing will be within the previously approved
work limit Two parking spaces will be created and a 4’ walkway to the existing dock as per the original plan of record. Agent McManus states to Mr. Slavinski that he will need to place another SE number on the side of the fixed pier and to stake out the pathway for inspection.
Motion made, seconded and unanimously carried to approve the Administrative Request of SE 43-2531.
4) Trustees of Reservation MOU (revised)
Agent McManus explains that this Memorandum of Understanding was carried over from the previous meeting and he had Steve Niccolle from the Trustees of Reservation the revision that was discussed at the last meeting. The amendment would include modifications to the parking lot and the trail leading down to the Trustees’ parcel. Currently, the MOU states that both organizations will endeavor to maintain the parking lot and the Trustees will pay for and construct a kiosk which will be supplied with trail maps. Mr. Niccolle has sent a copy adding a stipulation that both organizations will design and construct a path that will allow for safe passage from the town parking lot, across conservation lands and into the Trustees parcel
5) Updates:
- Cape Cod Water Resources Restoration Projects (email sent) – Agent McManus had forwarded correspondence between himself, Rick York and Joyce Mason regarding the Cape Cod Water Restoration grant money that has been received for “shovel ready” projects. Mr. York has taken the lead and created a list of projects that he has prioritized; two top priorities are the Santuit Pond Dam and Johns Pond Dam. The Santuit Pond Dam is currently undergoing phase inspections per the Mass office of Dam Safety and is showing the most evidence of undermining and seepage. Johns Pond Dam has embankments that are extremely steep and erosion is a serious concern in the upper and lower portions of the stream.
It was recommended that a representative from Waterways come in for discussion on how to obtain information regarding grants from the state for conservation issues/repairs.
- Herring Run Clean Up: – Agent McManus attended a meeting with the Wampanoag Tribe and their Natural Resources Committee to outline the plan for a multi-river cleanup to clear debris that might interfere with the Herring passage. It has been scheduled for March 5th where they will meet at the Route 130 plume and be split into groups to walk the upper reaches of the Quashnet, Santuit and Mashpee rivers to clear any obstructions.
- Mashpee Route Planning for Cape Cod Pathways Cape Walk: June 1st – June 10th (Drew McManus and Tom Fudala) - Agent McManus attended the Cape Cod Pathways workshop and lobbied for Mashpee trails to be part of their annual Cape Walk this year.

7:00 Town of Mashpee NOI SE 43-2601 (59 Sunset Circle) – Regrade Roadway & Stormwater System (Continued to 3/4/10 @ 7:09pm)

7:03 Matthew Mase NOI SE 43-2603 (97 James Circle) – Dock
Applicable Resource Area: Johns Pond/BVW
John Slavinski from Cape & Islands Engineering is representing the homeowners and is proposing the construction of a dock on John’s Pond with 3” Schedule 80 galvanized pipes which will be driven into the bottom of the pond. The walkway will be mechanically connected to the pipes. Mr. Slavinski explains that since this is a Natural Heritage area that they proceeded to file with them a few months ago and have had a study completed on the endangered species in the area which has been approved. The plans also received harbor master approval.

7:06 Warren Fields RDA (12 Popponesset Island Road) Title V Septic Upgrade
Applicable Resource Area: LSCSF & Coastal Bank
John Slavinski from Cape & Islands Engineering is representing the homeowner and explains the agreement with the Board of Health. The property had changed hands approximately two years ago and an agreement with the Mashpee Board of Health was made during that process stating that the current owner would be allowed to stay until the end of fall and no other person would be allowed to occupy the house until the septic system has been upgraded. Mr. Slavinski states that they are more than 100’ from the top of the bank but the proposed location of the new system is in the flood zone.
Agent McManus states that this project is straight forward and a significant improvement from the existing conditions. It will be a treated system with denitrification technology.

7:09 John & Kathleen Bibo SE 43-2604 NOI (58 Captains Row) – 2nd Level Addition & Septic Upgrade
Applicable Resource Area: Coastal Bank/Salt marsh
Andrew Garulay from Down Cape Engineering is representing the homeowner and explains that they would like to remove the roof to the dwelling and add a 2nd story which will increase the bedrooms from 3 to 5. In order to proceed with the addition, the owner’s will need to upgrade the septic system. Currently, there is a leaching facility and the owners would like to put in an IA Microfast system which the leaching component will be as far away from the resource areas and also elevated higher than the ground water. It will include a blower located about a foot behind the shed. No expansion of foot print but will place drywells to catch the roof runoff at both ends of the house and outside of the coastal banks.

7:12 Michael & Judy Welch RDA (277 Monomoscoy Road) – Extend Platform Cantilever
Applicable Resource Area: LSCSF/Coastal Bank (Bulkhead)
John Slavinski from Cape & Islands Engineering is representing the home owner. They have an existing vinyl bulkhead with platform and a 65’ ramp leading to a 10A Float. The area is an ACEC designation (Area of Critical Environmental Concern) and Mr. Welch would like to go a little deeper and farther out with the ramp and float but they can not put piles in. The idea is to cantilever out 10’ by using 3’ x 12’ pressure treated timber support on the vinyl wall and attach the ramp from the cantilevered section.
Agent McManus states that because of the ACEC this is the best and most reasonable alternative.
